Terms of Service

Welcome to Tangram. These Terms of Service ("Terms") govern your access to and use of Tangram, an AI-powered lesson personalization platform operated by Mosaic Instructional Planning LLC ("Mosaic IP," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using Tangram (the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the updated Terms.

2. Description of Service

Tangram is an AI-powered lesson personalization engine designed for K–12 educators. The Service allows teachers to build lesson plans aligned to standards and pedagogical frameworks, and to generate differentiated versions tailored to specific class compositions (e.g., ELL students, students with IEPs, varying reading levels).

The Service uses artificial intelligence to generate lesson content based on your inputs. AI-generated content should be reviewed by the teacher before classroom use. Tangram does not guarantee the pedagogical accuracy, completeness, or appropriateness of AI-generated content for any specific educational context.

3. Eligibility

You must be at least 18 years old to create an account and use the Service. The Service is designed for use by educators and educational administrators, not by students. By using the Service, you represent that you meet these eligibility requirements.

4. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately at team@gettangram.com if you become aware of any unauthorized use of your account.

5. Subscription and Payment

5.1 Free Trial

New users may access a limited free trial (currently 3 lesson generations) before subscribing. Free trial terms may change at any time.

5.2 Paid Subscriptions

Tangram offers monthly and annual subscription plans. Payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until your subscription expires.

5.4 Refunds

Subscription fees are generally non-refundable. However, if you are unsatisfied with the Service within the first 15 days of a new subscription, you may request a full refund by contacting team@gettangram.com.

5.5 Price Changes

We reserve the right to change subscription pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect for their account.

6. Your Content and Generated Content

6.1 Your Inputs

You retain ownership of all content you input into the Service, including lesson parameters, class context descriptions, and instructional preferences ("Your Content").

6.2 License to Us

By using the Service, you grant Mosaic IP a non-exclusive, worldwide, royalty-free license to use, process, and store Your Content solely for the purpose of providing and improving the Service.

6.3 Generated Content

Lesson plans, differentiated copies, and other outputs generated by the Service ("Generated Content") are provided to you for your use. You may use, modify, distribute, and share Generated Content without restriction.

6.4 No Ownership Claim

We do not claim ownership of Generated Content. However, similar or identical content may be generated for other users who input similar parameters.

6.5 Student Data

You represent and warrant that any student information you input into the Service does not include personally identifiable student information as defined by FERPA (34 CFR §99.3), unless you have obtained all necessary consents and authorizations. We recommend using de-identified descriptors (e.g., "Group A: below grade level in reading") rather than student names or identifiable information.

7. Student Privacy and FERPA

Tangram is designed for teacher planning use. It is not designed or intended to serve as a student information system or to store education records as defined under FERPA.

You are solely responsible for ensuring that your use of the Service complies with FERPA, COPPA, and any applicable state student privacy laws.

We do not knowingly collect personally identifiable information from students under 13. If we become aware that student PII has been input into the Service, we will take reasonable steps to delete such information.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service.
  • Use automated tools to scrape, harvest, or extract data from the Service.
  • Resell, sublicense, or redistribute access to the Service without our prior written consent.
  • Misrepresent AI-generated content as your original work in academic contexts where such misrepresentation would violate applicable policies.
  • Use the Service to generate content that is harmful, discriminatory, or inappropriate for educational settings.

9. Intellectual Property

The Service, including its design, features, software, algorithms, brand elements, and documentation, is the property of Mosaic Instructional Planning LLC and is protected by copyright, trademark, and other intellectual property laws.

"Tangram," "Mosaic IP," and associated logos and marks are trademarks of Mosaic Instructional Planning LLC.

Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use the Service as described herein.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

AI-GENERATED CONTENT MAY CONTAIN ERRORS, INACCURACIES, OR CONTENT THAT IS NOT APPROPRIATE FOR YOUR SPECIFIC EDUCATIONAL CONTEXT. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND ADAPTING ALL GENERATED CONTENT BEFORE USE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOSAIC IP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mosaic IP, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting team@gettangram.com or through your account settings. Sections 6, 9, 10, 11, 13, and 14 shall survive termination.

13. Dispute Resolution

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of laws principles.

Any dispute arising under these Terms shall first be submitted to good-faith mediation. If mediation fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

You agree that any arbitration shall be conducted on an individual basis and not as a class action or other representative proceeding.

14. General Provisions

Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mosaic IP regarding the Service.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
